1. Introduction
Welcome to OpenInformationSquare ("we," "our," or "us"). These Terms & Conditions ("Terms") determine your use of our yacht charter services and website at openinformationsquare.top (the "Service") managed by OpenInformationSquare.
By securing a charter or using our Service, you consent to comply with these Terms. Should you object to any portion of these terms, you should refrain from using the Service.
2. Service Overview
OpenInformationSquare offers luxury yacht chartering services, which include, among others:
- Yacht hire for the day
- Evening boat trips
- Business retreats
- Exclusive parties
- Extended charters over several days
Our services depend on availability and the climate conditions. We may alter or withdraw services at any given moment without prior notice.
3. Booking and Reservations
3.1 Booking Process
For a successful booking, you are required to:
- Have reached the age of 18 years
- Submit precise and complete information
- Make the necessary deposit as specified in the booking confirmation
- Accept these Terms & Conditions
3.2 Confirmation
Confirmation of your booking happens only after we have acknowledged payment and provided confirmation in writing. We have the authority to choose not to offer services to anyone at our discretion.
3.3 Availability
All charters are subject to the vessel's availability and favorable weather conditions. We will strive to oblige your preferred schedule as best we can.
4. Payment Terms
4.1 Pricing
All fees are quoted in € and comprise all taxes unless indicated otherwise. Prices are changeable without prior notice.
4.2 Payment Schedule
- Deposit: 50% of the full charter cost payable upon booking
- Final payment: Outstanding balance required 48 hours before the start of the charter
- Incidental costs (if applicable): Settled following the charter’s conclusion
4.3 Payment Methods
We accept the majority of credit cards, bank wire transactions, and certified bank drafts. Our systems process payments through secure, encrypted platforms.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- More than 72 hours before the scheduled departure: Full reimbursement minus any processing charges
- Between 24-72 hours before departure: 50% reimbursement
- Under 24 hours before departure: No reimbursement
5.2 Weather Cancellations
In the event that our captain deems weather conditions to be unsafe, we will propose to:
- Rebook your charter for another date without any extra cost
- Offer a complete refund if rescheduling is impractical
5.3 Mechanical Issues
Should there be mechanical issues with the vessel, we'll attempt to substitute it with an adequate replacement. If a substitute is not viable, we will issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
Every passenger is expected to:
- Observe all instructions from the crew
- Utilize any safety gear provided when necessary
- Notify us of any medical conditions that could impact safety
- Stay within the assigned areas on the boat
6.2 Prohibited Items
The following items are prohibited on the vessel:
- Glass receptacles
- Illegal substances
- Weapons or firearms
- Excessive amounts of non-alcoholic drinks (beyond reasonable consumption)
- Animals (except when pre-approved)
6.3 Conduct
Everyone on the charter is required to behave courteously. Anybody posing a danger to safety or disturbing other passengers may have their charter terminated immediately, without a refund.
7. Liability and Insurance
7.1 Our Liability
We limit our liability to the amount paid for your charter. We are not liable for:
- Injuries to individuals due to their own neglect
- The loss of or damage to personal belongings
- Indirect, consequential, or exemplary damages
- Delays due to climate or other situations beyond our control
7.2 Insurance Coverage
We maintain extensive maritime insurance that covers our fleet and operations. Passengers must secure their own travel and personal insurance.
7.3 Assumption of Risk
When you participate in our charter services, you recognize that ocean-related activities have inherent dangers, and you take responsibility for your personal safety and health.
8. Modifications and Itinerary Changes
We reserve the right to adjust itineraries, paths, or schedules owing to weather, security reasons, or due to service needs. We will endeavor to offer alternatives of similar value wherever possible.
9. Force Majeure
We shall bear no responsibility for failures, cancellations, or changes due to circumstances that are not under our control, including but not restricted to:
- Extreme climate conditions
- Acts of nature
- Government directives
- Port shutdowns
- Technical failures of vessels
10. Privacy and Data Protection
Your private information is managed in line with our Privacy Policy. By engaging with our services, you give your consent to the gathering and use of your data as outlined in our Privacy Policy.
11. Intellectual Property
All elements on our website, including text, images, logos, and graphics, are safeguarded by copyright and related laws. Unapproved reproduction, distribution, or creation of derivative works is forbidden.
12. Governing Law
These Terms are subject to the laws of Germany. Any resulting legal proceedings will be conducted in courts located in Hamburg, Germany.
13. Changes to Terms
We possess the right to amend these Terms at our discretion. Any revisions will be placed on our website and reflected by an updated revision date. Persistent use of our services after such adjustments will signify your acceptance of the new terms.
